Embracing PLR in Libraries: Thoughts on the UK PLR Office and Its Enlightenment 邱炯友 教授 國立政治大學圖書資訊與檔案學研究所 joyo@nccu.edu.tw 摘要 瞭解公共出借權 (Public Lending Right) 制度的行政管理機構發展，以及瞭解作家補償酬金規模與 ( 圖書館 ) 權利義務，係認識 PLR 實施景況最佳入門資料之一。本文主要論述英國 PLR 制度特性及酬金規模之演變，並且詳述英國 PLR Office 註冊中心近年組織改隸大英圖書館過程中所發生的各種爭議與變數。掌握這些事件資訊將有助於未來規劃 PLR 實施時引以為鑑。 前言 圖書館事業與「創作者」及「出版者」兩者關係最為密切糾纏的政策制度；也是最為利害與共的權利義務關係，則非所謂「公共出借權」或稱「公共借閱權」 (Public Lending Right ，以下簡稱 PLR) 莫屬。一般而言， PLR 制度的歷史精神始終在於照顧與尊重「作家」（創作者）權益為主要訴求。因此對於這些 PLR 主要權益人究竟能從制度中「獲利」多少？自然就成為眾人的焦點。這些 PLR 作家之著作於樣本圖書館中被借閱次數之景況，也就是所謂「圖書館借閱排行榜」的主要內容，也連同一般書市的「暢銷書排行榜」形成有趣的研究議題。除此之外，一個國家的 PLR 業管機構的組織委任，關係著未來實施該制度所涉行政調派的職權運用妥適性，從組織從屬之軌跡中，也可看出該國 PLR 制度的重要發展歷史，足可作為任何有意實施 PLR 制度的國家地區之借鏡。 本文僅單就兩項議題：英國 PLR 補償酬金給付規模之統計、業務移轉改事件進行探討，而前項議題僅作為後項議題之鋪陳。蓋從作家補償酬金規模與 ( 圖書館 ) 權利義務之間，係認識英國 PLR 實施景況最佳入門資料之一，而英國 PLR Office 的組織改隸事件卻也約略透露出：圖書館與作家 ( 以及出版界 )  向來微妙尷尬的關係，以及部分源自作家與出版界對於政府機構的不信任。整體而言，對於常為公部門機構的「圖書館」，作家與出版界又該如何真誠無怨的「擁抱圖書館」？或是善用圖書館的優勢來運作 PLR 制度？這是本文的旨趣。 一、英國 PLR
